During the election campaign, in articles, lectures and through Instagram, I expressed my absolute conviction that the possibility of an institutional rupture would be zero multiplied by zero divided by zero, that is, none. SpaccaIn view of statements in defense of democracy against coups by entities that envisaged such a possibility, by the Superior Council of Law of Fecomercio in São Paulo, we published a separate statement, reiterating our position that such a risk does not exist. The aforementioned council, which I have presided over for 33 years, is made up of 50 nationally renowned jurists, including the Constituent Assembly rapporteur himself, former senator Bernardo Cabral.
Six jurists bear the Minister José Geraldo Rodrigues Alckmin commendation granted by the institution, namely: the Minister of the Federal Supreme Court José Dias Toffoli; retired STF ministers Nelson Jobim and Marco Aurélio de Mello; the former presidents of the Court of Justice of São Paulo José Renato Nalini and Ivan Sartori and the former president of the Republic Michel Temer. After the elections and despite the Canada Email List crowds in front of the barracks calling for military intervention, I continue to clarify that the risk remains zero, a conviction that comes not only from the 33 years that I have taught at the Army Command and General Staff School and in conferences at the Escola Superior of War, but of the few conversations that, in the last four years, I had with the President of the Republic, Jair Bolsonaro, one of them after the elections
I calmly state that there is no possibility of institutional rupture, and the results of the elections must be respected. As an old professor, however, I could not, in this article, fail to bring to my students, readers and followers the way I interpret the Brazilian Constitution, and at what point lies my doctrinal divergence with the current eminent ministers of the Supreme Court, having already taught lectures, participated in doctoral committees and wrote books with many of them, about enjoying friendship, which greatly honors me, with most of the illustrious judges. Because I was on vacation, I read the first conviction of the elected president by the then judge Sergio Moro, in a sentence of more than 200 pages, based exclusively on evidence.
